AND IT CONCERNS, UH, BECAUSE I OWN A CONTINGENT PROPERTY, UM, IT CONCERNS TWO HOMES THAT ARE CURRENTLY BEING OCCUPIED, UH, ALONG MAY, UH, BERRY ROAD, UH, WITH TWO FAMILIES.

AND I HAVE CONFIRMATION, LOCAL CONFIRMATION, THEY'RE BEING CURRENTLY OCCUPIED.

AND, UH, ONE OF THE HOMES WAS ERECTED WITHOUT ANY BUILDING PERMIT WHATSOEVER.

SO SUB SUBSEQUENTLY, THEY WERE, UM, THE ENFORCEMENT INSISTED THEY APPLY FOR APPEAL FOR A BUILDING PERMIT.

WELL, THAT HOME HAS BEEN THERE FOR SEVERAL YEARS AND HAS ALSO BEEN OCCUPIED.

BOTH HOMES HAVE BEEN OCCUPIED FOR SEVERAL YEARS.

UH, THEY, THEY MEET NO ZONING RESTRICTIONS WHATSOEVER AS FAR AS SETBACKS FROM THE, FROM THE ROADS PROPERTY LINE.

THEY BOTH HOMES ARE, THEY'RE 15 FEET APART, WHICH IS VIOLATES ZONING REGULATIONS.

BUT EVEN MORE OF A CONCERN TO ME IS, I BELIEVE, AND I I'M SAYING THIS, BUT I WILL CHECK WITH THE HEALTH DEPARTMENT THAT THE SECOND HOME HOOKED UP

TO THE, BECAUSE OF ITS PROXIMITY TO THE FIRST HOME HOOK UP TO THE SAME SEPTIC SYSTEM AS THE FIRST HOME.

SO WE HAVE TWO FULLY OCCUPIED HOMES, ONE OF WHICH HAS NEVER HAD A BUILDING PERMIT, AND WHICH IS USING THE SEPTIC SYSTEM FOR TWO FAMILIES IN EACH OF THE HOMES, UM, THAT ARE USING THE SAME SEPTIC SYSTEM.

NOW, I, I HAVE NOT CHECKED WITH THE HEALTH DEPARTMENT, AND AS SOON AS I LEAVE HERE, IF, UH, IF CIRCUMSTANCES DICTATE, I WILL GO TO THE HEALTH DEPARTMENT, CONFIRM THAT THEY ARE HOOKED UP TO THE SAME SEPTIC SYSTEM, BUT IN ANY WAY THAT, THAT'S TOTALLY ILLEGAL.

I MEAN, YOU CAN'T, YOU CAN'T HAVE A HOME.

SO I HAVE VERIFICATION HERE WITH NEIGHBORS THAT BOTH HOMES ARE BEING OCCUPIED BY FAMILIES AS OF YESTERDAY OR THIS WEEK, THIS PAST WEEK.

SO I'M HERE TO SEE WHAT THE BOARD OF ZONING APPEALS PROCESS, WHAT ENFORCEMENT THEY ARE ENACTING TO, UH, FOR, TO, TO, UH, FORCE TO PROSECUTE THIS.

'CAUSE I CANNOT DO THAT.

I CAN'T BUILD A HOUSE 15 FEET FROM MY CURRENT HOUSE, AND I LIVE RIGHT.

I HAVE PROPERTY RIGHT NEXT DOOR WITHOUT A BUILDING PERMIT AND HOOK UP TO A SEPTIC SYSTEM.

SO IN ANY CASE, UH, I, I PRESENT MY CA PRESENT THAT CASE.

SO THE, THE SITUATION AS I KNOW IT IS THE SINGLE WIDE WAS THERE FIRST, AND THEN THERE WAS A PERMIT FOR A, UH, DOUBLE WIDE MANUFACTURED HOME, UM, WITH THE CONDITION THAT THE SINGLE WIDE WAS GOING TO BE REMOVED BEFORE THE CO WAS ISSUED.

UNFORTUNATELY, THE CO WAS ISSUED.

UM, SO NOW WE'RE, IT'S BASICALLY WE'RE TRYING TO GET A, OR THE APPLICANTS ARE TRYING TO GET AFTER THE FACT APPROVAL.

SO THERE WAS A BUILDING PERMIT FOR THE, THERE, THERE WAS A BUILDING PERMIT FOR FOR THE HOUSE.

FOR THE HOUSE, THAT'S CORRECT.

AND, AND THE HOUSE IS ADEQUATE DISTANCE FROM THE ROAD.

UM, THE HOUSE, IF YOU LOOK AT BULK ZONING REGULATIONS, WHICH WOULD BE FOR THE FRONTAGE WOULD BE 50 FEET FROM THE ROAD.

BUT BECAUSE THIS IS A POULTRY FARM, THERE ARE DIFFERENT SETBACK REQUIREMENTS MM-HMM .

FOR ANY PART OF THE POULTRY FARM, AND THAT WOULD BE 200 FEET FROM THE ROAD.

UM, NEITHER THE SINGLE WIDE NOR THE DOUBLE WIDE MANUFACTURED HOME MEETS THAT CRITERIA.

I, IT'S, IT'S MY BELIEF THAT THEY WOULD HAVE TO GET A VARIANCE, MORE THAN LIKELY, NO MATTER WHERE THEY PLACE IT FROM THE 200 FOOT, UM, VARIANCE FROM A PROPERTY LINE.

UM, NOW, IT, NOW IT COULD BE, IT, IT, IT COULD BE POSSIBLE DEPENDING ON HEALTH DEPARTMENT REGULATIONS.
